Definition of Battery

Navigating through the complexities of battery charges under Missouri law requires deft understanding and interpretation, and our law firm is dedicated to offering you formidable representation in such situations. With criminal defendants as our primary focus, we take on the mantle of unraveling the three pivotal elements that define the crime of battery. These elements as expounded under Missouri Revised Statute section 565.083 involve – unlawful application of force, intention behind the act, and the resultant harm or offense.

Our commitment is to earnestly interpret the nuances of these elements as aligned with your unique circumstances, assiduously building your defense. Leveraging our profound understanding of both the procedural and substantive aspects of the law, we aim to construct a robust defense strategy. Importantly, we underscore our dedication towards dignity and privacy and reassure you of a professional engagement that holds these values paramount.

With us, you can expect a thorough and comprehensive cross-examination of your case, irrespective of its intensity or complexity. Always remember, our law firm is in your corner, ensuring your rights are protected while vigorously contesting the battery charges.

At our law firm, we defend individuals who have been accused of a wide range of crimes that could be correlated with battery under Missouri law.

  • Assault: This is often associated with battery, involving the intentional harm or threat of imminent harm to another person. The intention behind the action and perceived harm by the alleged victim holds great significance in shaping the nature of the case.
  • Domestic Violence: This involves physical, emotional, or psychological abuse within the domain of a residential environment. The accused might be a spouse, former spouse, or any other individual living in the same household.
  • Child Abuse: Allegations of harm or threat of harm to a minor fall under this category. The level of severity can range from physical punishment to serious injury or endangerment.
  • Elder Abuse: This involves any form of mistreatment towards people who are 60 years or older. It can be physical harm, neglect, financial exploitation, or mental torture.
  • Aggravated Assault: This extreme form of assault is characterized by severe bodily harm or use of deadly weapon done knowingly or purposely by the accused. The severity of injuries inflicted can escalate the charges and penalties significantly.

Being charged with any of the above crimes can be a deeply stressful and difficult time. However, remember that charges are not convictions. Our Taney County battery defense lawyer ardently believes in your rights to a fair trial and presumption of innocence until proven guilty. We are dedicated to serving our clients by providing reliable, comprehensive, and vigorous defense strategies.

Penalties for Battery

In Missouri, the crime of battery is taken very seriously and carries substantial legal consequences. These penalties differ based on the type and severity of the battery committed. A simple battery offense, also referred to as fourth-degree assault, is classified as a Class C misdemeanor or a Class A misdemeanor. The perpetrator could face up to 15 days in jail and a fine not exceeding $700. A more severe form of battery, such as third-degree assault, can result in a more substantial fine and sentence. This is considered a Class E or D felony that could result in a conviction of up to seven years imprisonment. Second-degree assault can be a Class D or B felony.  However, first-degree assault, the most serious form of battery, is treated as a Class A or B felony under Missouri law. This charge could result in a prison sentence ranging from 5 to 30 years or, in rare cases, life imprisonment. There are factors that could heighten the severity of the penalties. For example, if the victim is a child under the age of 17 or a law enforcement officer, it could lead to an increased sentence.

We understand the nuances of the criminal justice system and are dedicated to providing a vigorous defense for our clients.
